While waiting for a decision on permanent residence or temporary residence, temporary residents have several options available to them through IRCC, Immigration, Refugees, and Citizenship Canada.

For instance, if a temporary resident applies to extend their stay in Canada, and is granted maintained Status, they can continue to do so under the same terms as their original permit until they hear back from IRCC.

In some cases, a Bridging OWP may be granted to a temporary resident who has applied for permanent residency but whose documents are about to expire (BOWP).

While extensions are possible for some temporary residence permits, others, like the Postgraduate Work Permit (PGWP), are not. But that doesn’t mean these employees can’t apply for and be granted a different type of work permit.

Students and workers in Canada should be aware that while a Temporary Resident Visa is an option, it is not always desirable. They are not permitted to attend school or work on this visa.

Until September 2021, foreign workers who meet the CEC’s requirements cannot apply for permanent residence. They may still be able to apply for other types of work permits, depending on their individual situations.

Open Work Permit for Spouse (SOWP)

If your spouse or common-law partner is a Canadian citizen, permanent resident, or spouse, you may be eligible for sponsorship through marriage.

There is a chance that spouses and dependent children of temporary residents can obtain open work permits. To qualify as a foreign worker, one of the following requirements must be met:

If you’ve been accepted into the Atlantic Immigration Program (AIP), you’ll be able to work in any field that has a skill level of 0–2–3.
To be employed in any field that has received a nomination through the Province Nominee Program, or to be employed in any field and to hold a Quebec Selection Certificate (CSQ).

Spouses of foreign students sometimes qualify for open work permits. If they can show the government that they are in a serious relationship and that their partner has enrolled in a program that allows them to work, they may qualify.
